Acceptance of Terms
By accessing the Return Message website or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the website or services. These Terms apply to all visitors, users, and customers of Return Message.
Services
Return Message ("we", "us", "our") provides AI receptionist, lead capture, appointment scheduling, follow-up automation, review request, and related call-handling services for local service businesses. The specific deliverables, features, fees, and onboarding details applicable to your subscription may be set out in a separate proposal, order form, or service agreement.
We reserve the right to modify, update, or discontinue any aspect of the service at any time. Where changes materially affect active subscribers, we will provide reasonable notice.
Account Registration
To use certain features of our service, you may be required to provide business and contact information during onboarding. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.
Fees and Payment
Pricing for the Return Message service is set out on our website or in a separate agreement. All fees are quoted in the currency stated at the time of purchase and are exclusive of applicable taxes unless otherwise noted.
- A one-time setup fee is payable before onboarding begins.
- Recurring monthly fees are billed in advance on each billing cycle.
- We reserve the right to update pricing with at least 30 days written notice before your next billing cycle.
30-Day Performance Guarantee
We offer a 30-day performance guarantee from the date your service goes live. If you are not satisfied with the service during this period, contact us and we will work with you to resolve the issue or discuss a refund of the monthly fee at our discretion. The one-time setup fee covers onboarding work already completed and is non-refundable.
Cancellation
You may cancel your subscription at any time by contacting us at support@returnmessage.com. Cancellation takes effect at the end of your current billing cycle. No refunds are provided for partial billing periods. Upon cancellation, access to the service and associated data will be removed in accordance with our Privacy Policy.
Customer Responsibilities
As a customer, you agree to:
- Provide accurate and up-to-date business information, including phone numbers, operating hours, and service details.
- Ensure that any connected systems, calendars, phone numbers, or workflows are authorised for use with our service.
- Use the service in compliance with all applicable laws and regulations, including those related to telecommunications, call recording, and data protection.
- Not use the service for any unlawful, fraudulent, or harmful purpose.
Call Recording and AI Disclosure
Our service may record and transcribe calls handled by the AI receptionist. It is your responsibility to ensure that call recording practices comply with the laws of your jurisdiction. Callers are notified at the start of each call when recording is active. By using the service, you consent to the use of AI to handle calls on behalf of your business.
Intellectual Property
All content on the Return Message website, including text, graphics, logos, design, software, and AI technology, is the property of Return Message or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of our website or service without our prior written consent.
Any data, call recordings, or lead information generated through the service on behalf of your business remains your data. We claim no ownership over your business data.
Acceptable Use
You agree not to misuse our website or services. This includes, but is not limited to:
- Attempting to gain unauthorised access to our systems or another user's account.
- Using the service to send spam, unsolicited messages, or engage in telemarketing.
- Interfering with or disrupting the integrity of the service.
- Reverse-engineering, decompiling, or disassembling any aspect of our technology.
We reserve the right to suspend or terminate access to the service if we reasonably believe these terms have been violated.
Availability
We aim to provide reliable, uninterrupted service, but we do not guarantee that the website or service will be available at all times. Website features, connected third-party platforms, and telephony infrastructure may occasionally experience interruptions, maintenance windows, or outages beyond our control. We will make reasonable efforts to minimise downtime and communicate any planned maintenance in advance.
Third-Party Services
Our service may integrate with or rely on third-party platforms including telephony providers, calendar systems, CRM tools, and payment processors. We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is subject to their respective terms and policies.
Limitation of Liability
To the maximum extent permitted by applicable law, Return Message and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the website or services. This includes, without limitation, loss of revenue, lost profits, loss of business, or loss of data.
Our total cumulative liability for any claims arising under these Terms shall not exceed the total fees paid by you to Return Message in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Return Message, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your breach of these Terms, or your violation of any applicable law or third-party rights.
Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify active customers. Continued use of the website or service after changes are posted constitutes your acceptance of the revised Terms.
